1. INTRODUCTION

We respect your rights to privacy and are very conscious of the provisions of the Privacy Act 1988 (Cth) (Privacy Act). The Privacy Act contains the Australian Privacy Principles (APPs) which cover areas including the collection, use, disclosure, quality and security of personal information. We are also conscious of the relevant health privacy principles under State and Territory legislation.

We, MyHealthScore Pty Ltd, own and operate the MyHealthScore platform (Platform) and websites and app (Websites).

The Platform facilitates confidential access to digital health services, including:

telehealth and video consultations with registered doctors (Partner Doctors) and other registered health providers, such as pharmacists, pathology providers and cosmetic nurses (Partner Providers); and

where clinically appropriate and after a telehealth or video consultation, the ability to request:

an online prescription, including delivery of the medication;

a referral for a pathology test;

a referral to a specialist doctor; and

a medical certificate.

We recognise the importance of your privacy and understand that the security of your personal information is important to you.

This privacy policy explains what information we collect about you, how we may use and disclose it, and the steps we take in relation to security.

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.

Special provisions apply to the collection, use and disclosure of personal information which is sensitive information. This includes health information and information about a person's race, ethnic origin, political opinions, membership of political, professional or trade associations, religious or philosophical beliefs, sexual preferences and criminal history.

In this privacy policy, all references to personal information include sensitive information unless indicated otherwise.

The Websites may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. We are only responsible for the privacy practices and security of our Websites. We recommend that you check the privacy and security policies and procedures of other websites that you visit.

2. PERSONAL INFORMATION WE COLLECT

We collect personal information about you from our interactions with you including through our Websites, Platform, telephone conversations with us, e-mails, chat and written and verbal communications.

The types of personal information we may collect and hold vary depending on the nature of our interaction with you and may include:

identifying and contact information such as your name, address, contact number and email;

health information such as information about your past, present or future health, the provision of telehealth services to you, and the provision of pharmacy scripts, pharmacy items and referrals. This may be information you provide to us via the Platform, the Websites or information provided by a Partner Doctor or Partner Provider through the Platform in the course of delivering services to you;

other types of sensitive information such as your gender at birth and whether you are of Aboriginal or Torres Strait Islander descent; and

government identifiers such as Medicare numbers and individual healthcare identifiers.

We may also collect de-identified information via cookies on the Websites. This information includes your browser type, operating systems and other websites visited. This information does not include any of your personal information and will not be used to link back to you individually.

We may collect personal information about a range of individuals including:

patients;

your next of kin or carer (Representative);

healthcare providers including Partner Doctors and Partner Providers;

job applicants, employees and contractors of MyHealthScore; and

third parties providing a service to MyHealthScore.

If you are a patient, we primarily collect personal information about you from:

you, when you use the Platform and/or the Websites;

you, when you contact us (whether by telephone, email, chat or through the Platform or Websites);

any person who, on your behalf and with your consent, provides information about you such as your Representative; and

any Partner Doctor or Partner Provider from whom you obtain services through the Platform.

If you engage with us as a Partner Doctor or Partner Provider, we may also collect personal information about your skills, qualifications and experience. Further details of this will be outlined in the Contractor Agreement or other agreements we have with you upon registering as a Partner Doctor or Partner Provider with MyHealthScore.

We may also collect personal information about you from third parties such as from Google, Facebook and Apple if you use these platforms to login to the Platform.

3. PURPOSES FOR WHICH WE COLLECT, HOLD, USE AND DISCLOSE YOUR PERSONAL INFORMATION

We collect, hold, use and disclose personal information for a range of purposes including the following:

to communicate with you;

for record keeping purposes;

to provide to you the functionality of the Websites and the Platform (e.g. if you are a patient, to connect you to a Partner Doctor or Partner Provider through our Platform);

to enable a Partner Doctor or Partner Provider to provide healthcare services through the Platform;

as required for delivery of the services provided through our Platform (but not by us) to you, including sharing of your address and phone number with third party providers for the purposes of parcel delivery and tracking;

as required for the ordinary operation of our Platform and Websites;

to manage our relationship with you, and to review, develop and improve our services to you and your experience with us;

to inform you about important matters relating to the Platform, the Websites or your personal information;

for market research;

to invoice and process any fees payable in relation to the services rendered through the Platform or Websites;

for quality assurance and training purposes and as may be required by our insurers;

to enable us to comply with laws and assist government or law enforcement agencies where we are required and authorised to do so;

where there is a serious and imminent threat to an individual’s life, health, or safety; or a serious threat to public health or public safety; and

for any purpose disclosed to you or required or authorised by or under law.

Our range of products and services and our functions and activities may change from time to time.

If you provide your email address, telephone and/or mobile phone number, you also consent to us using your email address, telephone and/or mobile phone number to contact you (including by telephone call, SMS or email) for any of the above purposes.

If you are a patient, your health information collected by us will only be used or disclosed:

to enable a Partner Doctor or Partner Provider who is providing services to you through the Platform to provide those services;

to third party suppliers and service providers, and other providers for the operation of our Platform, Websites and/or our business or in connection with providing our products and services to you (including for the purposes of delivering goods to you);

to those who work for us (whether as an employee or a contractor), our officers and related bodies corporate;

to payment systems operators (e.g. merchants receiving card payments, PayPal) and organisations who carry out credit, fraud and other security checks;

to your Representatives and specific third parties authorised by you to receive health information held by us (such as your nominated doctor who you would like to share your health information with);

should a Partner Doctor form the professional opinion that a patient is at imminent risk of harm, including self-harm, and where it is consistent with his or her professional and ethical obligations to do so, to contact emergency services (such as an ambulance service) to request a welfare check or similar intervention;

to any relevant government authority, where we reasonably believe that such disclosure is necessary;

to any entity with which we merge (or proposed to merge), or by which we are acquired (or proposed to be acquired) or to which we may sell all or part of our business and assets; and

to enable us to comply with laws and assist government or law enforcement agencies where we are required and authorised to do so.

If you do not provide us with personal information about you that we request, we may not be able to provide you with the products services you request.

We may de-identify, use and retain your personal information (excluding any eScript data) to conduct analysis on how the Platform, Websites and services are being used and to develop and enhance our Platform, Websites and services.

4. INFORMATION SHARING

We share your personal information with our related bodies corporate (as defined in the Corporations Act 2001 (Cth)) to enable us to conduct our business and provide the Platform, Websites and our services.

We also share your personal information with third parties, including:

persons or organisations engaged by us to assist us in carrying out the above purposes such as data storage providers, IT support providers, payment systems operators, providers of targeted online advertising and delivery partners; and

Partner Doctors and Partner Providers who provide services to you through the Platform, to enable them to deliver the products and services that you request from them through the Platform.

We do not share your personal information with other healthcare providers or pharmacists who are unconnected to the Platform, without your explicit consent.

For the purpose of complying with our financial audit obligations, we are required to divulge limited personal information about you to our financial auditors. Wherever possible, personal information used for the purpose of our financial audit is anonymised.

In addition to the above, if you are a patient, please refer to section 3.2 of this privacy policy for further information in relation to whom we may disclose your health information.

We require Partner Doctors and Partner Providers who provide services through the Platform to take reasonable steps to protect personal information from unauthorised loss or unauthorised access or use. Those Partner Doctors and Partner Providers may be required to take further steps to protect personal information under the professional regulations applicable to them.

You acknowledge and agree that, should we sell, merge or otherwise change control of our business, our company, the Platform or the Websites to a third party, we shall be permitted to disclose your personal information to the third party without giving notice or seeking prior consent from you. We shall also be entitled to assign the benefit of any agreements we have with you to the third party.

We may disclose de-identified information to third parties for the purposes of reviewing the quality of services delivered and conducting clinical research.

5. STORAGE OF PERSONAL INFORMATION

In order to help prevent unauthorised access, use or disclosure, we have put in place reasonable physical, electronic and managerial procedures to help safeguard and secure the personal information we collect.

We store the personal information we collect and use Transport Layer Security (TSL) to provide users secure and private access. Presently our intention is to store personal information collected by us on servers located in Australia. By using the Platform, you consent to our storing your personal information in this manner.

We take reasonable steps to protect your personal information, including the following:

Password protection: You are required to set up a secure password to use the Platform. The Platform does not permit automatic log-ins without that password. If you need to change your password, we use authentication methods to make sure it is you.

Secure storage and handling: We use a combination of firewall barriers, encryption techniques, data segregation techniques, backup and authentication procedures to help maintain the security of the Platform and to protect your account and your personal information.

Interoperability: We comply with robust interoperability requirements that aim to protect the flow and transfer of your data.

6. COOKIES AND TRACKING TECHNOLOGY

In common with many other website operators, we may use a standard technology called ‘cookies’ on our Websites. Cookies are small pieces of information that are stored by your browser on your computer’s hard drive and they are used to record how you navigate the Websites on each visit.

Cookies that are used in any part of our Websites will not be utilised for collecting personally identifiable information and will only be used for internal management purposes.

Most browsers automatically accept cookies, but you can usually change your browser to prevent cookies being stored. Please note, if you do turn cookies off this will limit the service that we are able to provide to you.

7. MARKETING AND PROMOTIONS

When you sign up to use the Platform, and unless you subsequently opt out, you consent to us using your personal information for marketing and promotion purposes.

If you consent to us using your personal information for these purposes, we may, from time to time, send you information in relation to products, services or other offers we think may be of interest to you, including to tell you about the services we offer on the Platform and the products and services offered by third parties. We will contact you via the preferred communication method you nominate through the Platform.

We use third party vendor remarketing services including such as Google’s ‘Customer Match’ and Facebook’s ‘Custom Audience’ to display ads. This means if you have provided us with your contact details, unless you opt-out of receiving direct marketing from us, we may upload these to third party vendors who perform remarketing services on our behalf.

We do not sell or disclose your information to third parties to market their products or services to you.

You can opt out of marketing communications at any time by using the unsubscribe facility in the relevant message or contacting our privacy officer using the contact details set out at the start of this privacy policy.

8. YOUR RIGHTS

Your rights in relation to the personal information held by us about you include:

Access: You can request a copy of your information, and to ask for it in a format that can be easily reused or transferred to another person or trusted healthcare provider.

Correct: You can ask us to correct or update your information.

Complain: You can express your concerns or complaints to us about your privacy or the way we are handling your personal information. We take your concerns seriously and will consider or investigate your complaint and endeavour to respond to your complaint within 14 days.

Closing your account: If you would like to close your Personal Account or Family Account, please access the “My Profile” section of the Platform and under “Account Closure”, select “Request Closure”. You can also email us at support@MyHealthScore.com.au. If you request that your Personal Account or Family Account be closed, the details you have provided and all information relating to your Personal Account or Family Account will be archived and stored securely by MyHealthScore for up to 7 years. If you request deletion of your data, our ability to comply with such requests may be limited by local law, in accordance with Health Records Act 2001 (Victoria), Principle 4 Data Security and Data Retention.

We will generally provide you with access to your personal information if practicable, and will take reasonable steps to amend any personal information about you which is inaccurate or out of date. In some circumstances and in accordance with applicable privacy laws, we may not permit you access to your personal information, or may refuse to correct your personal information, in which case we will inform you about the reason for this decision.

If you are not satisfied with the way we handle your query or handle your personal information (including our response to your request to access or correct your personal information), you have a right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) by visiting the OAIC website. If your complaint relates to the handling of your health information and you reside in Victoria, New South Wales or the Australian Capital Territory, you can lodge a complaint with the relevant State/Territory health complaints commissioner.

To exercise any of your rights in relation to your personal information, please contact our privacy officer using the contact details provided at the start of this privacy policy.

If you provide personal information to us about a third party (such as your directors, employees or someone you have business dealings with) you must ensure that you are allowed to give that information to us and that we are allowed to collect that information.

9. GENERAL

This privacy policy is effective from December 2023. As this privacy policy is updated from time to time, to obtain a copy of the latest version at any time, you should visit our Websites. Your continued use of the Websites and the Platform after changes are published constitutes your acceptance of the modified terms of this privacy policy.

Platform - Terms of Use

We, MyHealthScore Pty Ltd, own and operate the "MyHealthScore" platform, which is accessible via MyHealthScore.com.au and the MyHealthScore App (together, the Platform).

Throughout these Terms of Use and the Platform, the terms "we", "us" and "our" refer to MyHealthScore.

The use of the Platform by any user (you) is subject to these Terms of Use. By using the Platform, you agree to these Terms of Use which, together with the Privacy Policy, govern your access to and use of the Platform.

1. WHO WE ARE

MyHealthScore is a secure online digital healthcare platform that provides affordable and convenient health services to Australians, including by:

facilitating telehealth and video consultations with Australian-registered doctors (MyHealthScore Partner Doctors); and

where clinically appropriate and after a digital or telehealth consultation with an MyHealthScore Partner Doctor, facilitating:

access to online prescriptions, including delivery of medications;

the ability to request a referral for a pathology test;

the ability to request a specialist referral; and

the ability to request a medical certificate.

2. YOUR USE OF THE PLATFORM

2.1. ACCEPTANCE OF THESE TERMS OF USE

Your use of the Platform is subject to these Terms of Use. These Terms of Use contain important information, including warranty disclaimers and limitations of liability. Please read these Terms of Use carefully before accessing or using the Platform.

Your use of the Platform in any way, including, without limitation, browsing the Platform, using any information contained on the Platform, and/or purchasing any good or service provided by MyHealthScore or any person or third party engaged by MyHealthScore, constitutes acceptance of these Terms of Use, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. If you do not agree to all of the terms of these Terms of Use, then you may not access or use the Platform.

MyHealthScore reserves the right to update, vary or replace any part of these Terms of Use at any time by publishing a revised version of the Terms of Use on the Platform. Any new features or tools which are added to the Platform shall also be subject to the Terms of Use. You can review the most current version of the Terms of Service at any time on this page. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Platform following the posting of any changes constitutes acceptance of those changes.

2.2. APPROPRIATE USE OF THE PLATFORM

You must only use the Platform, including any third party platforms contained therein, for purposes described in these Terms of Use. You must not use or attempt to use the Platform:

for any unlawful purpose or in any way that may breach any law or regulation;

to solicit others to perform or participate in unlawful acts;

for any commercial purpose;

to submit, provide or upload false or misleading information or information that may be false or misleading;

to corrupt, damage or interfere with the Platform, including any third party platforms contained therein, or any third party data, software, hardware, website or information technology systems;

to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

to send, provide or upload any offensive, inflammatory, defamatory, fraudulent or otherwise unlawful information or information that infringes MyHealthScore' right, any MyHealthScore Partner Doctor's right or third party rights;

to adversely affect the reputation or public image of MyHealthScore or any MyHealthScore Partner Doctor;

to cause annoyance or inconvenience to MyHealthScore, any MyHealthScore Partner Doctor or any third party; or

to obtain any good or service offered by, or on behalf, of us, for someone other than you, unless you are their parent, guardian or carer and have their consent to obtain the good or service on their behalf.

You acknowledge that MyHealthScore can terminate your use of the Platform, including any third party platforms contained therein, and to the extent that you have a personal account on the Platform (Personal Account) or a Family Account (as that term is defined in clause 4.1), your Personal Account or Family Account, if MyHealthScore reasonably believes that you have breached these Terms of Use.

Without limiting the above, MyHealthScore reserves the right, in our sole discretion, to do any of the following without notice to you:

suspend or block your access to the Platform or part of the Platform;

limit or prohibit you from using your Personal Account or Family Account;

remove any material you send, provide or upload to the Platform; or

refuse to provide or supply you with any good or service offered by, or on behalf, of us.

2.3. INDEMNITY

You agree to indemnify, defend and hold harmless MyHealthScore and its related entities, its directors, officers, partners, employees, contractors, affiliates, suppliers, service providers and licensors (including the MyHealthScore Partner Doctors) from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of:

your use of the Platform;

your breach of these Terms of Service or the documents they incorporate by reference; or

your violation of any law or the rights of a third-party.

3. INFORMATION YOU NEED TO KNOW

3.1. DISCLAIMER

Unless provided directly to you by an MyHealthScore Partner Doctor, the information and content on the Platform is general and is provided for information purposes only. It:

is not, and is not intended in any way to be, or a substitute for, advice, such as professional medical advice including professional medical advice provided by MyHealthScore Partner Doctors during a telehealth consultation facilitated by MyHealthScore; and

should not replace a qualified health practitioner's independent judgment about the appropriateness or risks of a treatment or use of a particular product or service.

You should seek the professional advice of a qualified health practitioner with any questions you have regarding any medical conditions and/or the suitability of any products or services, including any products or services offered by MyHealthScore through the Platform. Never disregard professional advice given by a qualified health practitioner or delay in seeking it because of the general information you have read on the Platform. You and your health practitioners (including any MyHealthScore Partner Doctor you consult with) are exclusively responsible for any patient management and care decisions made with respect to using any product or service offered by MyHealthScore, and any consequences of such decisions.

MyHealthScore Partner Doctors are independent of MyHealthScore. If you consult with an MyHealthScore Partner Doctor, the MyHealthScore Partner Doctor is solely responsible for the healthcare services they provide to you, including compliance with standards of care, record keeping and other professional obligations, as well as compliance with privacy law. MyHealthScore is not a party to the health professional-patient relationship between you and an MyHealthScore Partner Doctor and is in no way involved in, or liable for, any services provided by an MyHealthScore Partner Doctor to you.

In some cases, the content on the Platform may incorporate or summarise views, guidelines or recommendations of third parties. Such content does not necessarily reflect the views of MyHealthScore, nor does it necessarily indicate a commitment by MyHealthScore to a particular course of action. Your reliance on any information provided by MyHealthScore is solely at your own risk.

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law)), MyHealthScore does not give any express or implied warranties and makes no representations in relation to the Platform. In particular, while reasonable care is taken in its preparation, MyHealthScore does not guarantee or warrant the accuracy, reliability, completeness or currency of the information on the Platform or its usefulness in achieving any purpose. You accept that content on the Platform may include technical inaccuracies and typographical errors. Information on the Platform should not be used without validating that information from appropriate sources and obtaining professional advice where it is prudent to do so. You should make and rely upon your own assessments and enquires to verify the accuracy of the information provided.

In addition, subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), MyHealthScore does not warrant that the Platform is free from any computer viruses or other defects or that your access to the Platform will be continuous or uninterrupted. MyHealthScore accepts no liability arising from your access to the Platform.

3.2. LIMITATION OF LIABILITY

The Platform comes with non-excludable warranties and guarantees under consumer protection legislation, such as that the Platform will be provided with due care and skill and be reasonably fit for its usual purpose.

Subject to the above and to the extent permissible by law, MyHealthScore and its directors, officers, partners, employees, contractors, affiliates, suppliers, service providers and licensors (including the MyHealthScore Partner Doctors):

accept no liability arising from the content on the Platform, or on websites linked from the Platform, being incorrect, incomplete or misleading; and

will not be liable for any loss, damage, cost or expense incurred or arising by reason of any person relying on the content that appears on the Platform.

4. YOUR PERSONAL ACCOUNT OR FAMILY ACCOUNT

4.1. ELIGIBILITY FOR A PERSONAL ACCOUNT OR FAMILY ACCOUNT

To be eligible to create a Personal Account and access that Personal Account, you must be, as a minimum:

residing in Australia (ie. have a current Australian address); and

planning to access the goods and services provided by MyHealthScore within Australia.

You may also create an account to use on behalf of another person, such as using the “family account” feature, provided they are the other’s parent, guardian or carer and have their consent to create the account.

MyHealthScore has the sole right to determine your eligibility to create and maintain a Personal Account or a Family Account, and to access the Platform or any part(s) of the Platform.

You must provide true, accurate and complete information when registering for and using your Personal Account or Family Account and must ensure that such information is current and up to date at all times. When obtaining product or services through the Platform, you must not omit any information that is relevant to the products or services you are obtaining.

4.2. YOUR RESPONSIBILITY FOR YOUR PERSONAL ACCOUNT OR FAMILY ACCOUNT

If you choose to create a Personal Account or Family Account, you are entirely responsible for your log in details and password and must not share these with any third party. From time to time, we may require you to re-authenticate yourself or issue any direction regarding your Personal Account, your Family Account or your use of your security credentials.

We are entitled to assume that you are the user whenever your security credentials are used to access a Personal Account or Family Account. You must notify MyHealthScore immediately of any known or suspected unauthorised use(s) of your Personal Account or Family Account, or any known or suspected breach of security, including but not limited to unauthorised access to the Platform or loss, theft or unauthorised disclosure of your password. You are responsible for all usage or activity on the Platform.

4.3. CLOSING YOUR PERSONAL ACCOUNT OR FAMILY ACCOUNT

If you would like to close your Personal Account or Family Account, please access the “My Profile” section of the Platform and under “Account Closure”, select “Request Closure”. If you request that your Personal Account or Family Account be closed, the details you have provided and all information relating to your Personal Account or Family Account will be archived and stored securely by MyHealthScore for up to 7 years. If you request deletion of your data, our ability to comply with such requests may be limited by local law, in accordance with Health Records Act 2001 (Victoria), Principle 4 Data Security and Data Retention.

5. OUR CONTENT

5.1. OUR INTELLECTUAL PROPERTY

The content on the Platform, including but not limited to text, graphics, logos, photographs and images is the property of MyHealthScore or its content suppliers and is protected by copyright law. The compilation of all such content is the exclusive property of MyHealthScore and protected by copyright law.

"MyHealthScore" and all related graphics, photographs, logos, and product and service names are trademarks (including unregistered trademarks) of MyHealthScore. These trademarks, logos and other proprietary graphics may not be used in connection with any other product or service without MyHealthScore' express prior written consent.

Except to the extent expressly stated in these Terms of Use, using the Platform does not give you any rights, title, interest or ownership in any intellectual property rights (including copyright) and proprietary rights to any content on the Platform or any trademarks, logos or other proprietary graphics of MyHealthScore.

5.2. YOUR USE OF OUR CONTENT

Subject to your acceptance of these Terms of Use, MyHealthScore authorises you to view, download and/or print a small number of copies of the content on the Platform for your personal, non-commercial use. Otherwise, no content on the Platform may be reproduced, modified, republished, transmitted, displayed, performed, or distributed in any way without the express prior written consent of MyHealthScore or as permitted by law. You may not modify, sell, assign, or transfer the content of the Platform or reproduce, display, distribute or otherwise use the content of the Platform in any way for any public or commercial purpose or otherwise except as expressly permitted in these Terms of Use. Content on the Platform is subject to change without notice at the discretion of MyHealthScore.

You are granted a limited, revocable and non-exclusive right to create a hyperlink to the home page of the part of the Platform which is accessible via a website so long as the link does not portray MyHealthScore or any MyHealthScore Partner Doctor or the functions and activities of MyHealthScore in a false, misleading, derogatory or otherwise offensive manner. If requested by MyHealthScore, you must remove any such hyperlink contained on the forum to which you have provided the hyperlink.

6. THIRD PARTY CONTENT

6.1. CONTENT HOSTED BY THIRD PARTIES ON THE PLATFORM

The chat function on the Platform enables you to chat with our support team in real-time. The chat function is facilitated by Intercom, Inc.. These Terms of Use, as well as any additional terms issued by Intercom, Inc. from time to time, govern your access to and use of the chat function on the Platform. Your use of the chat function constitutes acceptance of these Terms of Use.

6.2. THIRD PARTY LINKS

MyHealthScore may include links on the Platform to websites owned by other parties. These links may be represented in different ways, including as a standalone hyperlink and as content from the website owned by other parties which, if clicked, may direct you to the website owned by other parties. MyHealthScore is not responsible for the material contained on these websites or the availability of these websites. MyHealthScore does not endorse and is not responsible or liable for any content, including advertising or products offered on these websites, nor is MyHealthScore responsible for any damage, offence or loss caused as the result of visiting these websites. MyHealthScore recommends that before you visit any website you check that your computer is running up-to-date virus checking software.

By accepting these Terms of Use, you agree that you will not breach any right of a third party, including but not limited to contractual, copyright, trademark and privacy rights.

6.3. CONTENT ON THIRD PARTY SITES

When you use MyHealthScore' social media pages, you are using an external website and are bound by the terms and conditions of use of that website. We encourage you to review the terms and conditions of the relevant social media websites.

7. YOUR CONTENT

Any material you provide or send to MyHealthScore on, or via, the Platform will be deemed to be non-confidential and non-proprietary, unless it is indicated otherwise. This includes any data, questions, comments, suggestions, ideas or other information, but does not include your personal (including sensitive or health) information which you provide to us or an MyHealthScore Partner Doctor in the direct course of obtaining goods and services offered by, or on behalf, of us. MyHealthScore may use any material provided by you to MyHealthScore on, or via, the Platform which has not been indicated as being confidential or proprietary for any purpose without compensation to you.

Such material may also be transferred (in an encrypted form) over various networks and/or changed to confirm and adapt to technical requirements of connecting networks or devices. If you provide any payment information, this information will be tokenised by a third party so that we only ever receive a token when payments occur.

8. PRIVACY

Your personal (including sensitive and health) information will be collected by MyHealthScore, including if you choose to create a Personal Account or Family Account, make an order for any goods or services from MyHealthScore or contact MyHealthScore on or via the Platform. MyHealthScores' Privacy Policy, explains how MyHealthScore generally handles your personal (including sensitive and health) information. The Privacy Policy also includes information about how you can:

seek to access and/or correct your personal information MyHealthScore holds about you; and

submit a privacy query or complaint to MyHealthScore and how MyHealthScore will deal with your complaint.

By using the Platform, you agree that MyHealthScore can use your personal (including sensitive and health) information in accordance with its Privacy Policy.

9. COOKIES

If your web browser is set up to accept cookies, a cookie may be stored on your hard drive when you visit the Platform. Cookies allow MyHealthScore to collect information about your computer, which may include your IP address (a number assigned to your computer when you register with an Internet Service Provider), type of browser, operating system, domain name, and the details of any website which has referred you to the Platform. MyHealthScore uses cookies to track and collect information about which parts of the Platform (including links to other websites) are being visited by you. Cookies also allow MyHealthScore to recognise your computer while you are accessing the Platform. This information is used to maintain the quality of our service and to provide tracking and statistics regarding the use of the Platform.

If you would rather not have this information stored on your computer, you can configure your browser so it does not accept cookies. However, if you disable cookies you may not be able to access all parts of the Platform.

10. GOVERNING LAW

These Terms of Use are governed by and must be construed in accordance with the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and the Commonwealth of Australia in respect of all matters arising out of or relating to these Terms of Use, its performance or subject matter.

11. SEVERABILITY

Any provision of these Terms of Use which is invalid in any jurisdiction must, in relation to that jurisdiction, be:

read down to the minimum extent necessary to achieve its validity, if applicable; and

severed from these Terms of Use in any other case,

without invalidating or affecting the remaining provisions of these Terms of Use or the validity of that provision in any other jurisdiction.

Please read and accept these Terms of Service (Terms).

YOU MUST ACCEPT THESE TERMS EACH TIME YOU RECEIVE SERVICES THROUGH MyHealthScores' PLATFORM. MyHealthScore MAY VARY THESE TERMS AT ANY TIME AND MAY SUSPEND OR TERMINATE YOUR ACCESS TO THE PLATFORM AND / OR SERVICES PROVIDED BY MyHealthScore AT ANY TIME, WITHOUT NOTICE TO YOU.

1. SCOPE OF TERMS

  1. These Terms set out the basis on which MyHealthScore Pty Ltd (MyHealthScore) makes available to you, through the Platform:

    • the facilitation of telehealth consultations with MyHealthScore Partner Doctors; and

    • where clinically appropriate and after a digital or telehealth consultation with an MyHealthScore Partner Doctor:

      • the ability to request a prescription;

      • the ability to request a referral for a pathology test;

      • the ability to request a specialist referral; and

      • the ability to request a medical certificate,

    • (the Services).

  1. These Terms apply each time you access the Services. If you wish to access the Services, you must agree to be bound by these Terms by clicking the "I accept" button.

  2. You must accept these Terms each time you receive Services through the Platform, including when you:

    • request a telehealth consultation with an MyHealthScore Partner Doctor (Telehealth Consultation); or

    • complete a digital consultation to request a prescription, pathology test, specialist referral or medical certificate (Digital Consultation).

  1. Each time you receive Services will be a separate contract between you and MyHealthScore. If you do not accept these Terms, you will not be able to access the Services. A failure to comply with these Terms may result in MyHealthScore suspending or terminating your access to the Platform and / or the Services.

  2. From time to time, MyHealthScore may review and update these Terms, including to take account of new laws, regulations, products, services or technology. Any variation to these Terms will take effect from the date of publication on the Platform. The Terms which apply at the time you request a Telehealth Consultation or undertake a Digital Consultation are those that govern your access to the Services the subject of the Telehealth Consultation or Digital Consultation.

2. EMERGENCIES

  1. The Services through the Platform are not suitable for emergency circumstances. If you are in an emergency situation or need urgent and immediate assistance please contact 000 or your local hospital emergency department.

3. YOUR PERSONAL ACCOUNT AND USE OF THE PLATFORM

  1. The Services provided through the Platform are only available to individuals who:

    • reside in Australia (ie. have a current Australian address);

    • access the Services within Australia; and

    • who:

      • create a personal account with MyHealthScore through the Platform (Personal Account); or

      • create an account to use on behalf of another person, such as using the “family account” feature, provided they are the other’s parent, guardian or carer and have their consent to create the account.

  1. By creating a Personal Account or Family Account, requesting a Telehealth Consultation, undertaking a Digital Consultation or otherwise accessing the Services through the Platform, you confirm you are located within Australia.

  2. You must provide true, accurate and complete information when registering for and using your Personal Account or Family Account and must ensure that such information is current and up to date at all times. If any information you provide is inaccurate or incomplete, MyHealthScore may not be able to provide the Services to you.

  3. You are responsible for complying with the Platform Terms of Use and any other requirements necessary to access the Platform, create a Personal Account or Family Account, request a Telehealth Consultation, undertake a Digital Consultation or otherwise access the Services.

  4. You acknowledge that MyHealthScore can terminate, suspend or block your access to the Platform if MyHealthScore believes you have breached these Terms, the Website Terms of Use or any other requirements necessary to access the Platform. Without limiting the foregoing, MyHealthScore reserves the right, in its sole discretion, to do any of the following without notice to you:

    • suspend or block your access to the Platform;

    • limit or prohibit you from using your Personal Account or Family Account; or

    • refuse to provide or supply you with any good or service offered by, or on behalf of, MyHealthScore.

4. SERVICES

  1. When obtaining Services through the Platform, you must provide honest, accurate and complete information and not omit any information that is relevant to the Services you are obtaining. If you do not provide honest and accurate information or omit any information that is relevant to the Services you are obtaining, you may not be able to receive the full benefit of those Services.

  2. Subject to your compliance with these Terms, you may request a Telehealth Consultation or undertake a Telehealth Consultation or Digital Consultation using the Platform at any time.

  3. Notwithstanding clause 4.2, MyHealthScore Partner Doctors are only available during the hours advertised on the website (as updated from time to time). You may not be able to consult with an MyHealthScore Partner Doctor outside of these times.

  4. From time to time, you may be required to consult with an MyHealthScore Partner Doctor instead of or after you complete a Digital Consultation. You may also request to consult with an MyHealthScore Partner Doctor when you undertake a Digital Consultation. Where this occurs, you will be required to request a Telehealth Consultation with an MyHealthScore Partner Doctor.

  5. MyHealthScore Partner Doctors are independent of MyHealthScore and solely responsible for the healthcare services they provide to you, including compliance with standards of care, record keeping and other professional obligations, as well as compliance with privacy law. MyHealthScore is not a party to the health professional-patient relationship between you and an MyHealthScore Partner Doctor and is in no way involved in, or liable for, any services provided by an MyHealthScore Partner Doctor to you.

  6. MyHealthScore does not guarantee that a Telehealth Consultation or Digital Consultation is the appropriate course of treatment for your particular healthcare condition. The MyHealthScore Partner Doctor that you consult with will be solely responsible for determining:

    • whether or not a Telehealth Consultation or Digital Consultation is appropriate for you;

    • whether or not to provide the medical and/or health services you request; and

    • what health services (if any) are required.

  1. You should contact your regular doctor immediately if your medical condition changes or your symptoms worsen. If you require urgent care, you should contact your local emergency services immediately. You agree that, if you suffer from any noticeable side-effects from any medication or treatment you receive, you will either consult your regular doctor or contact us to facilitate a further consultation with an MyHealthScore Partner Doctor.

  2. You agree you will not record phone consultations unless you receive explicit written consent from the MyHealthScore Partner Doctor prior to commencing any such recording.

  3. MyHealthScore does not guarantee that you will be able to consult with a particular MyHealthScore Partner Doctor, or that you will not receive a consultation with a particular MyHealthScore Partner Doctor.

  4. You acknowledge that an MyHealthScore Partner Doctor may, in their absolute discretion, refuse to prescribe medication to you, issue you a repeat prescription and / or provide any other services or referrals requested by you. Any such refusal by an MyHealthScore Partner Doctor is not grounds for a refund.

  5. Without limiting clause 4.10, you acknowledge that MyHealthScore Partner Doctors are unable to:

    • prescribe controlled, addictive or Schedule 8 medications such as Diazepam, Endone, Lyrica, Stilnox, Zolpidem, Codeine painkillers (including Panadeine Forte), Benzodiazepine (including Valium / Diazepam, Temazepam, Oxazepam, Alprazolam), Duromine, Tramadol, Gabapentin, Pregabalin, Seroquel, Steroids, Vyvanse, Modafinil, Dexamphetamine, Ritalin, Concerta, Sofradex eardrops, Roaccutane;

    • provide backdated medical certificates; or

5. COLLECTION AND DELIVERY OF MEDICATION

  1. MyHealthScore is not a pharmacy and does not dispense any medication.

  2. MyHealthScore and/or a Pharmacy may contact the MyHealthScore Partner Doctor who issued your prescription in relation to that prescription.

  3. If you are prescribed a medication by an MyHealthScore Partner Doctor following a Digital Consultation or a Telehealth Consultation, depending on your circumstances, you may:

    • have an electronic prescription sent directly to you by email and / or SMS; or

    • have an electronic copy of your paper prescription sent to a Pharmacy.

  1. If you have an electronic prescription sent directly to you by email and / or SMS, you may attend a pharmacy of your choice to collect the medication that has been prescribed to you. MyHealthScore will not be involved, in any way, with the collection by you of such medication.

  2. If you have an electronic copy of your paper prescription sent to a Pharmacy, depending on availability and your circumstances, you may attend that Pharmacy to collect the prescribed medication. MyHealthScore will not be involved, in any way, with the collection by you of such medication.

  3. If you choose to have the prescribed medication delivered to your Shipping Address, then:

    • you agree to:

      • the applicable Pharmacy contacting you for the purpose of confirming details related to your prescription and obtaining all information it requires to dispense the prescribed medication to you; and

      • a Delivery Partner contacting you to confirm delivery details, including the method of delivery and your Shipping Address;

    • MyHealthScore will arrange for the collection of the dispensed medication from the Pharmacy and the delivery of that medication to your Shipping Address by a Delivery Partner;

    • you will be provided with an estimated delivery timeframe. You acknowledge that this is an estimate only and based on the assumption that the Pharmacy has all the information it requires to be able to dispense the prescribed medication to you and the Delivery Partner has all the information it requires to deliver the prescribed medication to you.Without limitation, if the Pharmacy or Delivery Partner does not have all the information it requires to dispense or deliver the prescribed medication to you (as applicable), then a different delivery time may apply;

    • you are responsible for ensuring that you have appropriate arrangements in place to accept delivery of your medication. MyHealthScore is not responsible for actions of a Delivery Partner, including:

      • the failure of a Delivery Partner to deliver medicines to the correct address;

      • the method of delivery used by any Delivery Partner; or

      • failure by a Delivery Partner to deliver medicines within any particular timeframe.

    • if the Shipping Address you provide is incorrect, you may be asked to provide a correct address. If you are unable to provide a correct address, your order may be cancelled;

    • if your order is cancelled after your medication has been dispensed from the Pharmacy, you will be charged for the medication and you will not be able to obtain a refund; and

    • in the event your medication appears to be damaged, wrongly dispensed or your delivery is delayed, you should contact MyHealthScore through the Platform to seek advice or replacement medication at admin@myhealthscore.com.

  1. You acknowledge that a pharmacy may, in its absolute discretion, reject your prescription and refuse to dispense medication to you for any reason. You acknowledge that MyHealthScore is not, in any way, involved in or responsible for the decision to dispense medication to you.

6. USAGE OF MEDICATION

  1. If an MyHealthScore Partner Doctor prescribes any medication, you must carefully read all information provided to you in relation to that medication (including information provided on the product packaging, patient information supplied with the medication, online material provided through the Platform (including by an MyHealthScore Partner Doctor or a Pharmacy) and the manufacturer’s consumer medical information leaflet).

  2. You must follow any advice provided to you by an MyHealthScore Partner Doctor you consult with and/or Pharmacy in relation to taking any medication prescribed to you.

  3. If you experience any serious side effects from any medication, you should seek emergency medical care immediately.

7. PRICE AND PAYMENT

  1. All charges and prices as shown listed are in Australian Dollars and are inclusive of GST (if applicable).

  2. The amount payable by you for each Service will be notified to you at the time you request a Telehealth Consultation or undertake a Digital Consultation (as is applicable). You should consider all applicable costs before finalising your request for a Telehealth Consultation or Digital Consultation.

  3. Payment may be made online by credit card, debit card or through a PayPal account. You are required to provide payment details at the time you request a Telehealth Consultation or undertake a Digital Consultation (as is applicable).

  4. By finalising a request for a Telehealth Consultation or Digital Consultation, you authorise MyHealthScore to run an authorisation check to confirm the validity of your payment details and availability of funds to pay for the Services you have requested. This check does not result in any charge to you. If your payment details do not pass the authorisation check, you may be contacted by MyHealthScore to confirm your payment details. If no authorised payment details have been provided, you may not be able to finalise your Telehealth Consultation or Digital Consultation.

  5. MyHealthScore will only arrange for funds to be debited against your nominated account as authorised in these Terms.

  6. Following completion of your Telehealth Consultation with an MyHealthScore Partner Doctor or the completion of your Digital Consultation, the relevant MyHealthScore Partner Doctor will instruct MyHealthScore to charge you for the Services received. You hereby authorise MyHealthScore to charge the cost of any Service against your nominated account.

  7. If you cancel your Telehealth Consultation at any time before it commences, you will not be charged for the Telehealth Consultation.

  8. For each successful payment, MyHealthScore will send you a receipt confirming payment to the email address you have provided.

  9. MyHealthScore may, in its sole discretion, vary the fees and payment terms applying to the Services at any time. Any change to the fees or payment terms applying to the Services will be immediately effective upon the publication of that change on the Platform and will apply to the Services requested by you following that change. If you have booked or paid for Services prior to a change in fees or payment terms being published on the Platform, but have not received the Services prior to that change taking effect, you will not be charged more for the applicable Services at the time you receive such Services.

  10. Services provided by an MyHealthScore Partner Doctor through the Platform are not covered under Medicare Australia, no Medicare rebate is available and bulk billing is not offered.

  11. If you are eligible to claim private health insurance benefits for any Services you receive, you are responsible for submitting the paid invoice to your insurer to claim any eligible benefits.

  12. You are solely responsible for maintaining the accuracy of your details, including your private health insurance details and any bank account or credit card details to which you would like to receive payments. MyHealthScore disclaims any and all liability for claims or payments which cannot be processed due to incorrect information provided by you.

8. REFUNDS

  1. Refunds for Telehealth Consultations or Digital Consultation are provided at sole discretion of MyHealthScore and MyHealthScore Partner Doctors.

  2. Subject to rights that cannot be waived under Australian Consumer Law, the cost of any medication that you choose to have dispensed (and delivered) to you through the Platform can only be refunded when:

    • you let MyHealthScore know you would like to cancel your delivery and the medication has not yet been dispensed by the applicable Pharmacy;

    • the Pharmacy is unable to dispense your medication; or

    • a product or pricing error is identified (and only to the extent that the error has caused you to be charged more than you ought to have been charged).

  1. Refunds are not permitted by the Pharmacy for medication once they have been dispensed.

  2. Refunds can only be made back to the payment method or credit card used for the original charge. Refunds may take up to five working days to be processed and appear in your card statement.

9. AVAILABILITY

  1. MyHealthScore does not permit you to choose to the MyHealthScore Partner Doctor who provides you a Digital Consultation or Telehealth Consultation.

  2. It is possible that the Services and / or MyHealthScore Partner Doctors available through the Platform at any given time may not be suitable for your needs. In that circumstance, MyHealthScore will seek to facilitate that the assessing MyHealthScore Partner Doctor help you select a suitable practitioner and / or refer you to an appropriate third party.

  3. If MyHealthScore is delayed or hindered in or prevented from performing any of its obligations under these Terms by reason of any event or circumstance beyond its reasonable control, MyHealthScore will have no liability to you in respect of such non-performance and the time for performing the same will be extended until the event or circumstance has ceased.

10. PRIVACY

  1. Your personal (including sensitive and health) information will be collected by MyHealthScore, including if you choose to create a Personal Account, request a Service, undertake a Telehealth Consultation or a Digital Consultation or otherwise access the Services, or contact MyHealthScore on or via the Platform. MyHealthScores' Privacy Policy, which can be accessed at www.MyHealthScore.com.au/terms/, explains how MyHealthScore generally handles your personal (including sensitive and health) information. The Privacy Policy also includes information about how you can:

    • seek to access and/or correct your personal information MyHealthScore holds about you; and

    • submit a privacy query or complaint to MyHealthScore and how MyHealthScore will deal with your complaint.

  1. By using the Platform, you agree that MyHealthScore can use your personal (including sensitive and health) information in accordance with its Privacy Policy.

11. LIMITATION OF LIABILITY

  1. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law, or any other applicable law, that cannot be excluded, restricted or modified by agreement.

  2. To the greatest extent permitted by law, MyHealthScore will not be liable to you for any direct or indirect lost profit, loss of opportunity, incidental, consequential or special damages, howsoever the loss is caused and regardless of whether it was foreseeable or not.

  3. To the greatest extent permitted by law, MyHealthScore makes no representations or warranties, express or implied, with respect to:

    • the merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights of the Platform or any medical or health related matter;

    • any treatment, information, advice or action relied on or followed by you; or

    • the Platform being available without interruption, error-free or free from viruses or other things that may interfere with the normal operations of your system.

  1. To the maximum extent permitted by law, MyHealthScores' liability will be limited to providing the Services again (or the cost of having the Services provided).

  2. You release MyHealthScore from all liability with respect to any matter concerning the health and medical services facilitated through the Platform, including information provided to you about those health and medical services.

  3. MyHealthScore will not be liable for any loss or damage resulting from the transmission of data as may occur during your use of the Platform.

  4. MyHealthScore will not be liable for any loss, damage, expense or claim arising from damage, loss, injury or death caused directly or indirectly by an MyHealthScore Partner Doctor, Pharmacy and/or Delivery Partner and you release MyHealthScore from any liability for any claim arising from any of those circumstances.

  5. Neither MyHealthScore nor any MyHealthScore Partner Doctor, Pharmacy nor Delivery Partner are responsible for loss or damage arising due to you failing to provide true or fully complete information or failing to comply with any of your obligations under these Terms.

  6. MyHealthScore will not be liable for any loss or damage which arises from your failure to inform any other healthcare provider about treatment you receive from an MyHealthScore Partner Doctor through the Platform.

12. OFFERS

  1. Certain offers made by MyHealthScore are subject to additional terms (as specified in the offer). You should read these terms carefully as time periods and the availability will often be limited.

  2. Where MyHealthScore offers a promotion, that promotion is provided by MyHealthScore Pty Ltd and is subject to the terms and conditions contained in this clause 12.

  3. If you want the benefit of the promotion, you will need to use the code specified in the promotion. Use of this code constitutes your acceptance of these terms and conditions.

  4. Your ability to use the benefit of the promotion expires on the date specified in the promotion and if no date is specified, on the second anniversary of the date on which the promotion was first published.

  5. The promotion can only be redeemed through the Platform.

  6. The promotion must not be copied or redistributed in any way.

13. GST

  1. In this clause 13:

    • terms or expressions which have a defined meaning in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) (GST Act) have the same meaning as in the GST Act; and

    • any reference to a party includes the representative member of a GST group of which that party is a member.

  1. Unless otherwise expressly stated, all consideration to be paid or provided under these Terms is expressed inclusive of GST.

  2. If GST is payable on any supply made under these Terms, the recipient must pay to the supplier an additional amount (GST Amount) equal to the GST payable on that supply at the same time as the consideration for the supply is to be paid or provided.

  3. Clause 13.3 does not apply to the extent that:

    • the consideration for the supply is stated to include GST; or

    • GST on the supply is reverse charged and payable by the recipient.

  1. The recipient need not pay the GST Amount until it has received a tax invoice or adjustment note, as the case may be.

  2. If an adjustment event arises in relation to a supply made under these Terms, the GST Amount must be adjusted to reflect that adjustment event. A corresponding payment must be made by the supplier to the recipient or by the recipient to the supplier, as the case may be.

  3. If these Terms require an amount to be calculated by reference to another amount (Reference Amount) that will be:

    • received for a taxable supply; or

    • paid for a creditable acquisition,

  1. then the Reference Amount must be reduced so as to exclude any part of the Reference Amount paid or received on account of GST, as the case may be.

  2. If these Terms require a party to reimburse or indemnify another party for a cost or expense, the amount of the cost or expense must be reduced by an amount equal to any input tax credit to which the party being reimbursed or indemnified is entitled for that cost or expense.

14. COMPLAINTS

  1. If you believe you have been incorrectly charged for a Service, or you have any other concern or complaint relating to the Services, please contact MyHealthScore at admin@myhealthscore.com

  2. MyHealthScore will seek to respond to your concern or complaint as soon as it is able, and will endeavour to resolve such concern or complaint with you.

15. GENERAL

  1. These Terms are governed by and must be construed in accordance with the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and the Commonwealth of Australia in respect of all matters arising out of or relating to these Terms of Use, its performance or subject matter.

  2. These Terms, and any provision of these Terms, are not to be construed to the disadvantage of a party because that party was responsible for their preparation.

  3. Headings in these Terms are intended for convenience of reference only. Forms of words will be construed to include singular or plural, and any gender, masculine, feminine, or neutral, as the context requires, and "including" means "including but not limited to". Reference to a person includes an individual, corporation, trust or statutory body.

  4. Nothing in these Terms will be construed as creating a relationship of partnership, of principal and agent or of trustee and beneficiary between you and MyHealthScore.

  5. Any provision of these Terms (or any part thereof) which is invalid in any jurisdiction must, in relation to that jurisdiction:

    • be read down to the minimum extent necessary to achieve its validity, if applicable; and

    • be severed from these Terms in any other case,

  1. without invalidating or affecting the remaining provisions of these Terms or the validity of that provision in any other jurisdiction.

16. DEFINITIONS

Australian Consumer Law means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Delivery Partner means any third party responsible for transporting medication from the Pharmacy to the Shipping Address.

Digital Consultation has the meaning given to that term in clause 1.3(b).

MyHealthScore means MyHealthScore Pty Ltd.

MyHealthScore Partner Doctors means Australian-registered doctors that provide services through the Platform.

Pharmacy means a pharmacy that has an arrangement with MyHealthScore in relation the receipt by the pharmacy of prescriptions.

Platform means the website accessible at www.MyHealthScore.com and the MyHealthScore app.

Services has the meaning given to that term in clause 1.1.

Shipping Address means the address you provide to MyHealthScore for the delivery of prescribed medication in accordance with these Terms.

Telehealth Consultation has the meaning given to that term in clause 1.3(a).

Terms means these Terms of Service.

You or you means the individual accessing the Services through the Platform.
